Sagutin po natin at ipaliwanag
ang mga nakasaad sa LTO Memorandum na naka petsa ng Marso 15, 2016, patungkol sa
guidelines ng pag iinspeksyon at apprehension kaugnay sa mga Top Boxes at
Saddle Bags ng mga Motorsiklo. (Guidelines on Inspection and Apprehension
relative to motorcycle Top Boxes and Saddle Bags)
May dalawang parte ang Memorandum
na ito. Una, ay ang mga alituntunin patungkol sa Top Boxes, at pangalawa, ay ang
alituntunin para sa Saddle Bags o Boxes.
I.
MGA ALITUNTUNIN SA TOP BOXES.
A. Ano
ba ang Top Boxes?
Ayon sa nasabing LTO Memorandum,
ang Top Boxes ay isang lalagyanan o tinatawag na “Storage Compartment” na
nakalagay sa likod na upuan ng isang motorsiklo at kinokonsidera na isang “Accessory”
ng Motor
(A TOP BOX is
a storage compartment fitted behind the seat of a motorcycle or scooter and is considered
a motorcycle accessory.)
B. Anong
Top Boxes ba ang maaring hindi na dumaan sa inspeksyon, rehistro o pagkahuli (apprehension)
ng LTO?
Ayon
sa Number 1 na parte ng nasabing Memorandum, ang mga Top Boxes na ispesipikadong
dinisenyo para sa motorsiklo at Scooter, at inaprubahan ng Department of Trade
and Industry (DTI), ay maaring hindi na dumaan sa inspeksyon, rehistro o
pagkahuli (apprehension) ng LTO, NGUNIT dapat ito ay sumunod sa alituntunin na:
a.
Ito ay nakakabit ng maayos at maigi sa motorsiklo;
at
b. Ang pinakamalaking kapasidad nito ay dapat
magkasya ang dalawang Full Faced Helmet.
(1. A top box
that is specifically designed for motorcycles and scooters and approved by DTI
may not be subject for inspection, registration or apprehension provided that
it conforms to the following:
a. It must be securely attached to the motorcycle.
b. It has a maximum capacity of two (2) full-faced helmets.)
C. Anong Top Boxes ba ang kailangang dumaan sa inspeksyon at rehistro ng LTO?
Ayon sa Number
2 ng nasabing Memorandum, Ang mga CUSTOM -MADE TOP BOXES na kalimitang
ginagamit sa Fast Food Delivery, ay dadaan sa inspeksyon at rehistro ng LTO, at
kailangang sumonod sa alituntunin na:
a. Ang Top Box ay nakakabit ng maayos at maigi sa
motorsiklo;
b. Ang dimension ng Top Box at hindi dapat lalagpas
sa 2 Feet sa haba at 2 Feet sa lapad at 2 Feet sa taas;
c. Ang Top Box ay kailangang hindi makasagabal na
makita ang daan sa pamamagitan ng side mirror ng motorsiklo.
Kung ang mga
nasabing alituntunin ay nasunod, kailangang mag bayad ng Isangdaang Piso
(P100.00) na Registration Fee para dito.
Ang isang hindi Rehistradong Custom-Made Top Boxes ay maaring hulihin ng LTO at mag-multa ng halagang Limang Libong Piso (P5,000.00) (Sec. 11-D DOTC Joint Administrative Order No. 2014-01)
(2. CUSTOM-MADE TOP BOXES (e.g.,
fast food delivery boxes) must conform to the following and are subject to
inspection and registration:
a. I must be securely
attached to the motorcycle.
b. The
dimensions must not exceed two (2) feet in length by two (2) feet width by two (2) feet in
height (2ft x 2ft x 2ft).
c. It must not impede or obstruct the view of the rider of the road from the side mirrors.
Provided that the abovementioned
requirements are complied with, a Pl00.00 registration fee shall be collected. Unregistered
custom-made TOP BOXES are subject to apprehension with a penalty of PS,000.00
pursuant to DOTC joint Administrative Order OAO) 2014-01 Section 11-D, Motor Vehicle
Operating Without or With Defective/Improper/Unauthorized Accessories, Devices,
Equipment and Parts.)
II. MGA ALITUNTUNIN PATUNGKOL SA SADDLE BAG O BOXES
A. Ano
ang Saddle Bags o Boxes
Ayon sa Number 3 ng nasabing Memorandum, ang Saddle Bags o Boxes ay ay
isang lalagyanan o tinatawag na “Storage Compartment” at kinokonsidera na “Accessories”
ng motorsiklo.

B.
Anong Saddle Bags ba ang maaring hindi na dumaan
sa inspeksyon, rehistro o pagkahuli (apprehension) ng LTO?
Ang Saddle Bags na ispesipikadong ginawa
para sa motorsiklo at scooter ay dapat aprubado ng DTI, ay ay maaring hindi na
dumaan sa inspeksyon, rehistro o pagkahuli (apprehension) ng LTO, NGUNIT dapat
ito ay sumunod sa alituntunin na:
a. Ang Saddle Bag nakakabit ng maayos at maigi sa
motorsiklo;
b. Ang pagkakakabit ng Saddle Bag ay hindi dapat mataas sa upuan ng motorsiklo at Scooter
(3. … Saddle bags that are
specifically designed for motorcycles and scooters and approved by DTI may not
be subject for inspection, registration or apprehension provided that it
conforms to the following:
a. It must be securely attached
to the motorcycle.
b. Installation of saddle bags
must not be higher than the seat of the motorcycle or scooter.)
D.
Anong Saddle Bag ba ang kailangang dumaan sa inspeksyon at rehistro ng LTO?
Ayon sa Number
4 ng nasabing Memorandum, Ang Custom-Made na Saddle Bag o Boxes ay ay dadaan sa
inspeksyon at rehistro ng LTO at kailangang sumonod sa alituntunin na:
a. Ito ay nakakabit ng maayos at maigi sa
motorsiklo;
b. Ang pagkakakabit ng Saddle Bag ay hindi dapat
mataas sa upuan ng motorsiklo at Scooter
c. Ito ay hindi dapat lalagpas ng labing apat na pulgada
(14 Inches) ang gilid nito;
d. Ang haba ay hindi lalagpas sa dulo ng motorsiklo
o scooter.
Kailangan din magbayad ng Isangdaang Piso (P100.00) Registration Fee sa LTO.
Ang isang hindi Rehistradong Custom-Made Saddle Bag o Boxes ay maaring hulihin ng LTO at mag-multa ng halagang Limang Libong Piso (P5,000.00) (Sec. 11-D DOTC Joint Administrative Order No. 2014-01)
(4. CUSTOM-MADE SADDLE BAGS or
BOXES must conform to the following and are subject to inspection and
registration:
a. It must be securely attached to the
motorcycle.
b. Installation of saddle bags
must not be higher than the seat of the motorcycle or scooter.
c. They shall
not exceed fourteen (14} inches from the sides.
d. Length must not exceed the tail end of the motorcycle or scooter.
Provided that
the abovementioned requirements are complied with, a Pl00.00 registration fee
shall be collected.
Unregistered
custom-made SADDLE BAGS or BOXES are subject to apprehension with a penalty of
PS,000.00 pursuant to DOTC joint Administrative Order 2014-01 Section
11-D, Motor Vehicle Operating Without or With Defective/Improper/ Unauthorized
Accessories, Devices, Equipment and Parts.)
III. Sino ang maaring humuli sa mga nagkasala sa LTO Memorandum na ito?
Ayon sa nasabing Memorandum, ang LTO Law Enforcement
Officers at ang kanilang Ahente (Agent) na inatasan ng LTO para ipatupad ang mga
nasasaad sa batas na RA 4136 o ang “Land Transportation and Traffic Code” at
iba pang tuntunin patungkol sa Land Transportation ay binibigyang
kapangyarihan o pinapayagan na hulihin
ang mga lumabag sa Memorandum na ito.
Ngunit hindi kasama dito ang mga ahente na humuhuli
para sa mga paglabag sa Anti-Drunk and Druggard Driving Act, Anti-Smoke Belching
Act at Anti-Overloading Law.
Ang lahat na may ari ng motorsiklong may Custom-made
na Top Boxes, Saddle Bag o Boxes ay kailangang magparehistro at binibigyan ng
siyamnapung araw mula sa petsa ng Memorandum, na iparehistro ang mga ito sa
LTO.
(Only LTO Law Enforcement Officers and Agents deputized by LTO to enforce the provisions of R.A. No. 4136 and other related land transportation laws, rules and regulations, are authorized/ allowed to apprehend violators of the provisions of this Memorandum. Agents deputized by LTO specifically for R.A. No. 10586 (Anti-Drunk and Drugged Driving Act}, Section 46 of R.A. 8749 (Anti-Smoke Belching Act} and R.A. No. 8794 (Anti-Overloading Law} are barred in enforcing the provisions of this Memorandum. All motorcycle owners with unregistered custom-made TOP BOXES or SADDLE BAGS or BOXES are given ninety (90} days from the date of this Memorandum to register the same with the LTO.)
